These are the Terms and Conditions of Zenith Cosmetic Clinics Limited (Number 07227968) registered office 6 Clinton Terrace, Derby Road, Nottingham NG7 1LY (Zenith)
1. General
a) ‘Patient’ is any person who has contacted Zenith requesting a consultation for, or who has entered into a Contract with Zenith for the provision of Cosmetic Treatment or Dental Services
b) ‘Doctor/Surgeon’ – A medical practitioner who is registered with the General Medical Council or a Fellow of the Royal College of Surgeons or an equivalent foreign qualification.
c) ‘Dentist’ – A dentist who is registered with the General Dental Council.
d) ‘Anaesthetist’- A medical practitioner who is registered with the General Medical Council and has admitting privileges to the hospital or clinic where any Treatment is undertaken.
e) ‘Contract’ – The legal agreement between Zenith and the Patient for the provision of Cosmetic Treatment or Dental Services under the terms and the Fee as set out in any Quotation supplied by Zenith.
f) ‘Treatment’- the agreed method of carrying out the Cosmetic Treatment or Dental Services
g) ‘The Literature’- Any Patient Information Booklet and associated letters and leaflets supplied by Zenith to the Patient
h) ‘The Fee’- The sum payable for the provision of the Treatment as set out in any Quotation provided. The Quotation is valid for 90 days from the date of issue only. The Consultation Fee is for the initial Consultation only. The Treatment Fee is for carrying out the Treatment.
i) ‘Payment’ – can be by Cash, BACS, debit and credit card. A charge will be made for American Express.
j) ‘Working Day’- Monday to Saturday excluding UK Bank Holidays in any week.
k) ‘Days’- All the days in a week including Bank Holidays
l) ‘The Clinic’ – is the premises at 6 Clinton Terrace Derby Road Nottingham NG7 1LY, 39 Harley Street London W1G 7JB or such other premises as Zenith shall advise the Patient.
m) These Terms and Conditions will represent the whole of the agreement between Zenith and the Patient.
2. Disclosure
To safely provide the Treatment, the Patient will be requested to supply certain information in writing before anything is done. This information will be checked from time to time throughout provision of the Treatment. The information must be provided completely and accurately by the Client as it will be relied upon by Zenith in the provision of the Treatment and any other services. Any changes must immediately be passed to Zenith.
3. Children
a) Patients are requested not to bring children with them to the Clinic. The Clinic staff cannot provide any childcare.
b) If any Child under 16 years attends the Clinic for a Treatment, then consent to any Treatment must be given by a parent or guardian who must be present throughout any appointment and Treatment.
c) No one under 18 years will be treated for Dental Services at the Clinic.
d) Children under the age of 16 years cannot be unaccompanied within the Clinic or hospital. They must be chaperoned in the reception by a parent or guardian.
4. Medical
a) It is essential that the Patient provides Zenith with an honest health history that is as accurate, reliable and as full as possible.
b) If a Patient has any concerns about their current state of health, they must consult their GP before booking any appointment
c) The Patient must notify Zenith as soon as possible if a change occurs to their health or wellbeing after the initial consultation.
d) The Patient understands that withholding medical information could put their health at risk. If issues arise because of information being withheld or incorrectly given, then Zenith shall have no liability for the consequences.
e) If correct medical information is not provided and later becomes apparent to the Doctor/Surgeon, Dentist or at the Hospital or Clinic, then the Doctor, Surgeon or Dentist has the right to not carry out the Treatment without any refund being made to the Patient.
f) Staff are always available to discuss any concerns regarding any medical conditions or possible medical conditions, and it is for the Patient to make full disclosure and act on any advice given.
g) For all medical information provided to Zenith, the Patient must provide their consent for the data to be retained by Zenith as otherwise no Treatment can be supplied, and Zenith will have no liability to the Patient. Such consent will initially be obtained at the initial consultation.
5. Medical Professionals
a) Zenith will engage Doctor/Surgeons who are registered with the General Medical Council and hold the qualifications and experience required under Schedule 3 of the Health and Social Care Act (Regulated Activities) Regulations 2010 to perform all Surgery.
b) Zenith will engage Dentists who are registered with the General Dental Council and hold the appropriate qualifications and experience.
c) Doctor/Surgeons are obliged to maintain full Private Practice Medical Indemnity Insurance with the Medical Defence Union, the Medical Protection Society or any other appropriate insurer approved by Zenith.
d) Dentists are obliged to maintain full Private Practice Medical Indemnity Insurance with an appropriate insurer approved by Zenith
e) The decision of any Doctor/Surgeon or Dentist as to if any Treatment can proceed and the manner in which this will be carried out is final. This will include their assessment of the state of mind of the Patient and if they have carefully considered the risks and benefits of the intended Treatment.
6. Patients from Outside the UK
a) Full Payment of the Treatment Fee must be received when booking the Treatment.
b) If full Payment is not received 28 days prior to the Treatment date the appointment will be cancelled.
7. Appointments
a) A Patient should arrive ten minutes prior to an appointment for a Treatment.
b) Late arrival for an appointment over fifteen minutes from the arranged time will not be seen and a rescheduled time may be offered.
c) If Zenith cannot accommodate the Patient who has arrived late on the same day the Patient will lose their deposit. A new deposit must be paid to book another appointment.
d) If any Fee is not cleared in the bank account of Zenith and the Patient does not give the appropriate notice set out in these Terms and Conditions, then any appointment will be cancelled, and the full Fee will become payable.
e) Zenith are not responsible for the belongings of Patients whilst at the Clinic. Anything of value should not be brought to the Clinic or if it is it should be handed to a member of Zenith staff for safekeeping.
8. Dental Treatment
a) The Patient will be informed of the current charge (the Consultation Fee) for the initial Consultation Appointment at the point of booking. This will be invoiced and must be paid before the Consultation can take place.
b) The Patient will be asked to the Clinic for a Consultation appointment at which medical details will be collected, the Patient examined, and the Treatment agreed.
c) At the Consultation appointment the Patient will be provided with details of the Treatment Fee. The Fee will be put in writing should the Client request this.
d) If the Patient books a Treatment appointment for the agreed Treatment a deposit will be payable. If this is not paid the appointment will be cancelled.
e) The balance of the Treatment Fee will be payable on the day of the Treatment appointment.
f) If the Treatment is performed immediately at the Consultation appointment the full treatment Fee must be paid before the Patient leaves the Clinic
g) If an arrangement is made for payment in instalments when the Treatment involves more than one visit to the Clinic, then the instalments must be paid in advance as arranged before each Treatment takes place.
h) £50 rolling deposit refundable at the end of each course of treatment
i) The Patient must sign a medical consent form before any Treatment can take place.
9. Non-Surgical Treatments
a) Following an initial inquiry, the Patient will be asked to come into the Clinic for a Consultation at which medical details will be collected and the Treatment explained.
b) The Patient will be informed of the current charge (Consultation Fee) for the Consultation. This must be paid before the Consultation can take place.
c) If Zenith then decides the Patient is appropriate for the Treatment and the Patient, then proceeds with the Treatment, the Consultation Fee may be redeemable or refundable against the Treatment Fee depending on the Treatment and Doctor/Surgeon involved. Otherwise it is non-refundable.
d) At the Consultation the Patient will be provided with details of the Treatment Fee. The Treatment Fee will be put in writing should the Client request this.
e) Booking an appointment for some Treatments will attract a Treatment Deposit payable immediately.
f) If the Patient wishes to change the date of the Consultation, then at least 48 hours’ notice must be given to the Clinic or the Consultation Fee will be lost and must be paid again before any further appointment can be booked.
g) For some Non-Surgical Treatments, the Treatment Fee, or the balance of the Treatment Fee if a Treatment Deposit has been paid, must be paid in full twenty-eight days before the Treatment takes place otherwise any appointment will be cancelled. The Patient will be informed if this will apply to the Treatment they require.
h) For other Non-Surgical Treatments, the Treatment Fee, or the balance of the Treatment Fee if a Treatment Deposit has been paid, must be paid when the Patient has their Treatment.
i) If an arrangement is made for payment in instalments when the Treatment involves more than one visit to the Clinic, then the instalments must be paid as arranged before each Treatment takes place.
j) The Patient must sign a medical consent form before any Treatment can take place.
10. Surgical Treatments – Pre-Surgery
a) The normal Treatment will be that the Patient may have a Consultation with a Patient Coordinator and will have a Consultation with a Surgeon. Medical details will be taken, and the Surgeon will decide if the Patient is appropriate for the Treatment requested.
b) A Consultation Fee as per the current price list is payable before the initial Consultation with the Surgeon or Patient Coordinator can take place. This is redeemable against any subsequent Treatment.
c) Except as mentioned above all Consultation Fees are non-refundable including where the Patient fails to attend the agreed appointment for the Treatment.
d) If the Patient wishes to change the date of the Consultation, then at least 48 hours’ notice must be given to the Clinic or the Consultation Fee will be lost and must be paid again before any further appointment can be booked.
e) Following the Consultation with the Surgeon the Patient will be provided with a written Quotation of the Treatment Fee. It is for the Patient to accept this Quotation if they wish to proceed whereupon they enter into a contract with Zenith
f) Payment of the Treatment Fee must be made at least 28 days before the appointment for any surgical Treatment or else the Treatment may be cancelled.
11. Cooling Off Period
a) As recommended by the guidelines issued by the Independent Healthcare Association, Good Practice in Cosmetic Surgery May 2013 (in consultation with the General Medical Council) Zenith will provide adequate time for reflection before proceeding with any Treatment.
b) The Doctor/Surgeons at Zenith will not normally admit any Patient for a Cosmetic Treatment within 14 days of the initial consultation with them.
c) The Patient may however choose to sign a relevant disclaimer in consultation with the Surgeon or Nurse at the Pre-operative Assessment and undergo the Cosmetic Treatment within the 14-day period.
d) Zenith are careful regarding the state of mind of the Patient in respect of the proposed Treatment and will only accept a disclaimer as above if satisfied that the Patient has carefully considered the benefits and risk a of the intended Cosmetic Treatment.
12. Payment of the Fee for a Surgical Treatment
a) Upon booking an appointment for a Surgical Treatment following receipt of a Quotation a non-refundable Treatment Deposit will be immediately payable
b) The Patient must attend the Clinic 7 – 10 days before the appointed day for surgery for pre- Surgical assessment. If the patient does not attend the surgical appointment will be cancelled and the Treatment deposit becomes non-refundable.
c) The balance of the Treatment Fee will be payable 28 days before the date agreed for the surgery.
d) If the date of the surgery is less than 28 days in the future when booking, the full Treatment Fee will be immediately due.
e) If the sums due are not paid the Treatment will not go ahead.
13. Rescheduling Policy
a) If a Patient reschedules a Treatment date, then a Rescheduling Fee is payable.
b) If under 7 days’ notice is given to Zenith for Dental Services by the Patient a Rescheduling Fee of £25 will become payable
c) If under 28 days’ notice is given for Cosmetic Treatment a Rescheduling fee of £75 will become payable.
d) The Cooling Off period is unaffected by this clause.
e) If a Patient postpones a Treatment for medical reasons a Rescheduling Fee will not be charged if the Patient provides Zenith with written evidence from a suitably qualified medical professional stating that the Patient is not fit to undergo the Treatment and Zenith is satisfied with the evidence supplied.
f) Zenith reserves the right to reschedule any Treatment without any liability to the Patient if it is necessary due to matters beyond its control such as a hospital or surgeon becoming unavailable.
g) £50 rolling deposit refundable at the end of each course of treatment
h) The Treatment can be postponed or even cancelled by Zenith in the interests of patient safety and welfare. This will include but Is not limited to a failure by the Patient to follow the advice given to them by Zenith, e.g. to stop smoking or if it transpires that the Patient has not provided a full medical history. Zenith has no liability to the Patient in these circumstances. If Treatment has to be postponed or cancelled under this Clause and it is less than 28 days to the Cosmetic Treatment appointment (7 days for Dental Services) the full Treatment fee will be retained by the Clinic.
14. Cancellation Policy for Cosmetic Treatment
a) If the Patient decides to cancel the Treatment without rescheduling or is deemed by Zenith to be not fit for surgery, including pregnancy, the Treatment Fee payable will depend upon the period of notice given to Zenith.
b) If over 28 days’ notice of cancellation is given to Zenith, there will be no cancellation Fees and a refund given.
c) If between 21 and 28-days’ notice is given of cancellation, then £1000 or 50% of the Treatment Fee is payable whichever is the greater.
d) If between 21 and 14-days inclusive notice is given of cancellation, then £1000 or the full Treatment Fee is payable whichever is greater.
e) If less than 14 days’ notice is given of cancellation, then the full Treatment Fee will be retained.
f) If the Patient fails to attend the appointment for the Treatment without any notice, then the full Treatment Fee is payable.
g) For non-surgical Cosmetic Treatment covered by Clause 9(h) at least 48 hours’ notice of cancellation must be given, or the full Treatment Fee will be payable. Non-surgical Cosmetic Treatment covered under clause 9(g) will be the same as for Surgical Cosmetic Treatment as above.
h) If a Treatment is postponed or cancelled by Zenith in the interests of the patient’s safety and welfare in over 14 days from the Treatment appointment the Treatment deposit of £1000 is not refundable. If postponed or cancelled by Zenith 14 days or less before the Treatment appointment the full Treatment Fee is payable. This will include but is not limited to cancellation due to pregnancy and health conditions including colds.
i) If a Treatment already rescheduled by the Patient is subsequently cancelled or an attempt made to reschedule for a second time, then this Cancellation Policy will apply.
j) All Treatment Fees will be refunded if the Treatment is cancelled by the Patient during the Cooling Off period.
15. Cancellation Policy for Dental Service
a) If the Patient decides to cancel the Treatment without rescheduling or is deemed by Zenith to be not fit for Treatment, the Fee payable will depend upon the period of notice given to Zenith.
b) If less than 7 days’ notice is given of cancellation, then the full Treatment deposit will be retained and is non-refundable. This will include where the appointment was made less than seven days before the Treatment date
c) If a Treatment already rescheduled by the Patient is subsequently cancelled or an attempt made to reschedule for a second time, then this Cancellation Policy will apply.
d) If a Patient fails to turn up for an appointment or give the required period of notice or rearrangement when they have committed to a package of Treatments, then the Clinic will allocate the cost of the missed Treatment against the package price and reduce the total Treatment supplied accordingly. The Treatment Deposit will be allocated against the Package price.
16. Patient Obligations
a) The Patient must be honest and act in good faith at all times.
b) The Patient must read and make sure they understand all information given to them orally and in the Literature supplied by Zenith. If they do not understand they must ask for clarification until they do understand.
c) The Patient must comply with all the Pre-surgery, Post-Surgery and any other advice and instructions given to them by Zenith or be responsible for the consequences of such action.
17. What the Surgical Treatment Fee covers
a) The engagement of the Doctor/Surgeon to carry out the Treatment at the agreed location.
b) Pre-Operative medical assessment and routine blood tests at Zenith or an external hospital. Normal bloods and MRSA are included.
c) The Doctor/Surgeons fees during the clinic or hospital stay. These include the pre-surgery consultation, surgery, surgical rounds and post-operative care.
d) The Anaesthetist fee including the pre-operative consultation, the operation and immediate post-operative care.
e) Nursing care immediately following surgery and during the necessary recovery monitoring period.
f) For Surgical Treatments simple painkillers, antibiotics and dressings immediately postoperative at the Clinic or hospital prior to discharge.
g) Only medicines given at the time of discharge are included in the Treatment Fee. Medicines required after discharge are not included.
h) The Treatment Fee does not include echocardiogram examinations, scans, additional blood tests, x rays, ultrasound scans or mammograms, any other diagnostic examination, GP or specialist fees for letters or medical history.
i) If an external hospital is used all costs for an overnight stay are included. Additional unplanned nights are charged at £500 per night plus all medicines and consumables. The room must be vacated as soon as discharge has occurred usually by 8.30am.
j) If during the Treatment the Surgeon discovers another area not envisaged at the Consultation that needs attention in order to properly complete the Treatment this may incur an additional cost to the Treatment Fee quoted. The Patient is deemed to have consented to this additional work and to any extra charge by proceeding with the Surgery
k) If during the Treatment the Surgeon discovers something that they consider needs further investigation in the interest of the Patient’s welfare the costs of such investigation will be an extra Fee. The Patient is deemed to have accepted any such cost in proceeding with the Surgery.
18. What the Dental Treatment Fee covers
a) The engagement of the Dentist to carry out the Treatment at the agreed location.
b) Pre-Treatment medical assessment.
c) The Dentist fees during for the Treatment.
d) X-rays and any other diagnostic tests will be charged as an extra.
e) If during the Treatment the Dentist discovers another area not envisaged at the initial Consultation that needs attention in order to properly and safely complete the Treatment this may incur an additional cost to the Treatment Fee quoted. The Patient is deemed to have consented to this additional work and to any extra charge by proceeding with the Treatment.
f) If during the Treatment the Dentist discovers something that they consider needs further investigation in the interest of the Patient’s welfare the costs of such investigation will be an extra Fee. The Patient is deemed to have accepted any such cost in proceeding with the Treatment.
19. Aftercare Policy
a) The Patient must attend all post-surgery and other post Treatment appointments set by Zenith and follow all advice and guidance supplied by Zenith and in Literature provided by them.
b) If there are any problems immediately after Treatment, the Patient must contact Zenith as soon as possible. Failure to comply with this clause will make the remainder of this condition 19 applicable at the discretion of Zenith.
c) If it is mutually agreed between the Doctor/Surgeon and the Patient that corrective surgery is required within one year of the original Cosmetic Treatment then Zenith will provide corrective surgery, clinic or hospital accommodation and nursing care, free of charge if clinically appropriate.
d) If the Doctor/Surgeon considers that the result of the original Cosmetic Treatment falls within the acceptable normal limits, further free surgery will not be available and normal costs would apply.
e) Any changes in appearance through a Patient’s lifestyle, pregnancy, illness or the natural ageing process that affect the original Cosmetic Treatment will be considered and may prevent any further free treatment.
f) If the original Doctor/Surgeon is not available, then Zenith will appoint a suitable alternative Doctor/Surgeon to determine the appropriateness of any further surgery.
g) If the Patient moves to a different part of the United Kingdom, Zenith may appoint a suitable alternative Doctor/Surgeon to decide on the appropriateness of additional surgery.
h) Normal fees will apply to a Patient one year from any Cosmetic Treatment in all circumstances.
20. Breast Enlargement
a) Zenith will endeavour to use good quality implants.
b) The implants are covered by the manufacturer’s warranty. Details will be issued to you at the time of your pre-operative assessment or can be obtained directly from Zenith.
21. Finance
a) Details of zero per cent finance and other interest-bearing options are available to help spread the cost of the Treatment. Any finance application must be approved at least 28 days prior to the Treatment appointment.
b) If for any reason preapproved Finance cannot be completed, then the Patient will be personally responsible for the Fee payable immediately
22. Disabilities
If a Patient has a disability or any care requirements, they must inform Zenith at the time of booking and upon arrival for any Appointment. This is necessary to ensure the staff can make any necessary adaptions to ensure that the Patient can be professionally dealt with.
23. Limit of Liability
a) Zenith will not be liable in contract, tort or otherwise for any economic loss (including, without limitation, loss of profit), or for any other special, indirect or consequential loss or damage arising out of, or in connection with, its provision of any Treatment for the Patient
b) Nothing in these Terms and Conditions will limit or exclude liability for death or personal injury resulting from negligence or any liabilities that may not be excluded by law.
24. General Data Protection Regulation
Zenith will comply with the General Data Protection Regulation (GDPR) and all other applicable Data Protection legislation. They will provide a copy of their Privacy Notice on their website www.zenithcosmeticclinics.co.uk. Zenith will only process data to the extent required to enable it to provide the Treatment or Product and as necessary to comply with its own legal obligations. Zenith may contact the Patient with details of similar treatments and offers in the future, as allowed by the GDPR.
25. Photographs
Photographs may be taken before and after a Treatment. They are a vital part of certain Treatments and the medical record. They will be stored privately with the Patient’s medical record and are strictly confidential.
26. Confidentiality
All details and any information supplied by the Patient to Zenith will be kept strictly confidential by them. Any information supplied to Zenith will be used by them solely for providing the Treatment unless obligated to provide it by law, court order or any Governmental or regulatory authority.
27. Severance
If one or more of these terms are found to be unlawful or otherwise unenforceable, that provision will be deemed severed from the remainder of these Terms and Conditions, which will remain valid and enforceable
28. Complaints
a) In the unfortunate event that a Patient Is not happy with the service provided by Zenith complaint should be made as soon as possible to Zenith Clinic Manager at Zenith Cosmetic Clinics, 6 Clinton Terrace, Derby Road Nottingham NG7 1LY. Any telephone call must be followed by putting the complaint in writing to that address.
b) If the issue cannot be resolved by the Clinic Manager following the Treatment set out in the Complaints Policy, then the Patient should contact a Director of Zenith at the same address.
c) The Patient should follow the current Complaints Treatment set out in the current Complaints Policy.
d) Any complaint will be documented and passed to the Care Quality Commission at their next inspection. If a Patient is not satisfied with the outcome at Clinic level, they can write direct to the Care Quality Commission at CQC National Customer Service Centre, Citygate, Gallowgate, Newcastle upon Tyne NE1 4PA.
29. Law
These Terms and Conditions will be governed by the laws of England
